Learner's licence rules in South Africa: what you can and can't do

How long a learner's licence is valid, who can supervise you, where you can drive, and what the penalties are for breaking the rules.

A learner's licence is not a full driver's licence. It lets you drive legally on South African roads, but only under specific conditions. Ignore these conditions and you're driving unlicensed - which carries the same penalties.

Validity period

A learner's licence is valid for 24 months from the date it was issued. If you don't pass your K53 (driver's test) within that time, the learner's expires and you must start over.

There is no renewal option. If it expires, you sit the learner's test again.

The supervisor requirement

Every time you drive on a public road with a learner's licence, a licensed driver must be seated in the front passenger seat.

Requirements for the supervisor:

  • Holds a valid South African driver's licence for the same code or higher
  • Is present in the front passenger seat (not the back)
  • Must be sober and fit to drive
  • Must be at least 18 years old (though the law specifies licence-holding, not age)

Your parent, older sibling, or driving instructor all qualify. A friend with a licence qualifies. The supervisor doesn't need to be registered anywhere - they just need a valid licence and must sit in the front.

Where you can drive

A Code B learner may drive on public roads with a licensed supervisor. The NRTA does not explicitly prohibit freeways for learner drivers by name - however, the learner's exam tests freeways as an off-limits road type, and the vast majority of DLTCs and instructors apply this restriction in practice. Avoid freeways until you hold a full licence.

Roads marked "no learner drivers" are off-limits.

Must your vehicle be marked?

No law requires a learner driver to display an "L" plate in South Africa (unlike the UK). Some instructors use them for courtesy - to warn other drivers - but they're not legally required.

Can a learner drive at night?

Yes. The learner's licence restrictions are about supervision and road type, not time of day. You can drive at night as long as you have a licensed supervisor in the passenger seat and avoid freeways.

Carrying passengers

A learner driver with a supervisor may carry passengers. There's no restriction on the number of passengers beyond the vehicle's lawful capacity.

Penalties for breaking the rules

Driving without a supervisor: treated as driving without a licence. Fine, demerit points, and possible charge.

Driving on a freeway with a learner's: traffic offence.

Expired learner's licence: if you're stopped, you're treated as an unlicensed driver.

After 24 months: what to do

If your learner's expires, reapply:

  1. Book a new learner's licence test (same process as the first time)
  2. Pay the fee again
  3. Pass the theory test again
  4. Your practical experience still counts - you just need the new certificate
