Every time a learner driver takes a car onto a public road, a licensed supervisor must be in the front passenger seat. Here's exactly what the law requires.
The legal requirement
Under the National Road Traffic Act, a learner driver may only drive a motor vehicle on a public road if a person who holds a valid driver's licence for the relevant code or higher is seated in the front passenger seat.
Who qualifies as a supervisor
- Holds a current, valid South African driver's licence
- Holds the correct code - for a Code B learner, the supervisor needs Code B or EB
- Must be in the front passenger seat (not the back)
- Must be sober (blood alcohol below the legal limit)
- There is no requirement to be a registered instructor
Your parent, older sibling, spouse, or any licenced friend qualifies. Driving instructors qualify automatically.
What the supervisor does NOT need
- A professional driving instructor certificate
- To be registered with any authority
- To own the vehicle
- To be over a specific age (though they must be old enough to hold the licence)
Can two learners supervise each other?
No. Both people in the vehicle must hold valid licences to count - a learner cannot supervise another learner.
What happens if you drive without a supervisor
Driving a motor vehicle on a public road without a supervisor while holding only a learner's licence is treated as driving without a licence. The penalties mirror those for unlicensed driving:
- Fine (can be substantial)
- Vehicle may be impounded
- Criminal record risk in serious cases
Traffic officers check this. If you're stopped at a roadblock or after an incident with no supervisor present, expect a charge.
What about motorcycle learners?
A Code A or A1 learner may not ride on a public road unless a licensed Code A or A1 rider rides within 100 metres of them. Because a motorcycle only has one seat, the supervisor requirement is modified - but you still cannot ride alone to open roads without a qualified supervisor present.
Night driving
There is no prohibition on learners driving after dark. The supervised driving rules apply 24 hours a day. You can drive at night as long as you have a supervisor in the front passenger seat and stay on roads with a 60 km/h limit or below.
Practice routes and driving schools
When driving with a registered driving school in a school-owned vehicle with the instructor, the instructor counts as the supervisor. You don't need a separate private supervisor.
